Mc Culloch v Maryland [ Landmark Case ] 1819

Before 1819, the State of Maryland passed legislation that the State would impose a tax on the Bank of the United States.  James W. Mc Culloch sued the State of Maryland, stating that the actions of the Maryland Legislative were unconstitutional, and the Maryland Court of Appeals ruled in the State’s favor. Mc Culloch appealed to the United States Supreme Court, and the Court ruled in Mc Culloch’s favor. The Supreme Court found that the State of Maryland’s actions were unconstitutional. The ruling is considered the first “landmark” case the United States Supreme Court decided.

Brady v Maryland [ Landmark Case ] 1963

In 1963 the US Supreme Court decided in the case of Brady v State of Maryland that the State in a criminal case shall turn over ALL exculpatory evidence to the defense in a criminal trial. Brady v State of Maryland has affected the judicial landscape for the last 60 years. It is considered one the more important criminal decisions of the Twentieth Century.

Maryland v King 2013

In 2013 the U.S. Supreme Court held that conducting a DNA swabbing on a prisoner is not an invasive procedure and can be used as routine procedure in processing a person as a result of criminal arrest. The procedure does NOT violate the 4th Amendment. The Supreme stated that determining an arrestee’s identification serves as a proper and legitmate procedure for the State to use in processing the prisoner for identification purposes.

The State of Maryland has been known to have left-of-center voting for decades. The central State jurisdictions, i.e., the City of Baltimore, Prince George’s County, Montgomery County, Howard County, and Baltimore County, control the agenda of the State Legislature. In 2020, the five jurisdictions controlling the State Legislative repealed the 48-year-old Maryland State Law Enforcement Officers Bill of Rights. The excuse for the repeal was the ‘George Floyd” Incident.

The State of Maryland Law Enforcement Bill of Rights ( LEBOR ) was originally passed in 1974. It was the first such law passed in the United States. The new law set down standards and procedures for law enforcement agencies to discipline themselves, which the left-than-center politicians held in disdain.

Two additional results of the of the Replacement Bill: (1) No-Knock Warrants were limited thereby eliminating the element of surprise and safety, (2) Law Enforcement Officers convicted of injuring or murdering someone while judged using ‘Excessive Force’ are subject to a possible ten year prison sentence.

By repealing the law over the then-Republican Governor’s veto, the Democrats controlled legislature effectively gutted effective law enforcement as had been known for half a century. Today, the moral of the average Maryland Police Officer is in the “tank.” The decision has helped the rise in crime, low morale, and low recruiting numbers.
